IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION # 10-116
Resolution to acknowledge past Acceptance and Dedication of Outlot B of Northridge Estates, First Addition to the City of Monticello, Jones County, Iowa.
WHEREAS, The City of Monticello previously approved the Final Plat to Northridge Estates First Addition to the City of Monticello, Jones County Iowa by way or Resolution 03-136 on July 16, 2003, and
WHEREAS, Within the body of the Resolution the City accepted the Dedication of public improvements described as, “…including but not limited to Northridge Drive (formerly Industrial Park Drive) and Valley Drive (formerly Prull Drive), which are streets included within and adjacent to said plat, and all curb, gutter, paving, storm sewer, sanitary sewer, water and utilities, is approved and hereby accepted.”, and
WHEREAS, The City Council finds, based upon a review of the Resolution approving the final plat referenced above, along with the Developer’s Agreement related to Northridge Estates dated July 16, 2003 and approved by Resolution #03-135, that the intention of the Council was at that time to accept the dedication of the Dry Retention Basin, a/k/a “Outlot B of Northridge Estates, First Addition”, and that all records of the City and the County should correctly reflect that past acceptance and dedication.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby acknowledge the past acceptance and dedication of Outlot B of Northridge Estates, First Addition”, and directs the City Clerk to take any steps necessary to ensure that the dedication of said parcel is noted within appropriate City records and further directs that a copy of this Resolution be forwarded to the County Auditor and the County Assessor to ensure that they understand the position taken by the Council that said parcel, Outlot B, was previously accepted and dedicated for public purposes as part and parcel of the storm sewer system and infrastructure of Northridge Estates First Addition.
