THE CITY OF MONTICELLO, IOWA
RESOLUTION #11-129
Approving Payment related to agreement between City of Monticello and Gary Hughes associated with storm water management cost share.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City of Monticello previously enacted a storm water management ordinance to be used by the City for City storm water related purposes, and/or to be used as a cost share with private property owners on storm water related projects, and
WHEREAS, The City previously agreed to share in an eligible private project with Gary Hughes and has made one prior payment under said agreement, same being by Check # 28541 on 11/24/10 in the amount of $4,274 to B & J Hauling and Excavating, and
WHEREAS, Gary Hughes has now completed his obligations under the agreement and requests final payment, and
WHEREAS, The City Council finds that it is obligated under the agreement to pay the first $861.00 of the B & J Hauling & Excavation Inc. invoice, and 50% of the balance of the invoice in the amount of $4,382.40 for a total obligation of $5,243.40, and further finds that the balance now owing is $969.40, representing the total obligation of the City ($5,243.40) less the amount previously paid to B & J Excavating ($4,274.00).
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 6th day of September 2011, that it is appropriate for the City to pay $969.40 to Gary Hughes consistent with the agreement between the City and Gary Hughes.
