The City of Monticello, Iowa
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #11-143
Authorizing City Clerk, and Deputy City Clerk in the absence of the City Clerk, to certify liens to the County Treasurer for unpaid utilities
pursuant to Iowa Code §384.84(4)(a)(1).
WHEREAS, The City of Monticello operates a water, sanitary sewer, storm water, and sanitation utility, and
WHEREAS, From time-to-time customers fail to pay the balance due on their account after appropriate billing and notice as required by code and it becomes necessary to certify a lien against the property to protect the City’s interest and to ensure payment to the City of the accrued amount due, and
WHEREAS, The Code of Iowa was recently amended, Code §384.84(4)(a)(1), to allow City Council’s to designate personnel of the city utility to certify liens when appropriate without prior City Council approval, and
WHEREAS, The Council has, as standard practice, always approved liens when proposed by City Staff and by allowing the City Clerk or the Deputy City Clerk, in the City Clerk’s absence, to certify liens would result in improved efficiencies and time savings.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby authorize the City Clerk, or Deputy City Clerk in the absence of the City Clerk, to certify liens related to any and all city utilities to the Jones County Treasurer for collection without prior approval of the City Council as authorized by Iowa Code § 384.84(4)(a)(1).
