IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #11-152
Resolution to request Abatement of accrued taxes at Riddle Property, 615 E. Washington Street, Monticello, IA 52310
WHEREAS, The City of Monticello is the owner of the property located at 615 E. Washington Street, Monticello, Iowa, former site of Riddle Manufacturing, having acquired the property by Deed dated May 9, 2011, with Real Estate taxes being past due or accruing through the date of the deed for the following periods:
Tax Year 2009: 7/1/2009 through 12/31/2009 Due: September, 2010
1/1/2010 through 6/30/2010 Due: March, 2011
Tax Year 2010: 7/31/2010 to 12/31/2010 Due: September, 2011
1/1/2011 to 5/9/2011 Due: March, 2012
WHEREAS, When the City accepted ownership of the Riddle Building the City did not receive any pro-rated taxes from Mr. Riddle, the property taxes having been sold on two prior occasions. The City has spent approximately $13,250 on asbestos removal (1/2 of total cost with IDNR paying other ½), $500 on an asbestos project design, $900 on an abstract update, $10,000 on demolition, $9,000 on the settlement of prior tax sales, and will spend approx. $3,500 on the removal of the Underground Storage Tank, which should be reimbursed by the State UST Removal fund, with an approximate total City investment, assuming reimbursement from the State for the UST removal, in the amount of $33,650 related to the Riddle property, and
WHEREAS, The City acquired the Riddle property to rid the City of a contaminated, nuisance and dilapidated structure located in the floodway and flood plain and will not profit financially from the acquisition of said property, and
WHEREAS, The Council finds it appropriate, under the circumstances, to not pay any of the accrued taxes, whether yet due or not, and to so inform the County Treasurer for action to abate said taxes by the County Board of Supervisors as required by the Iowa Code, and
WHEREAS, the City Council previously approved Resolution # 11-99 on July 5, 2011 directing the City Clerk to inform the County of the Council decision to not pay any accrued taxes on this property and to request the formal abatement of same, through the date the City acquired ownership, and
WHEREAS, The County was so notified and the Board of Supervisors abated the taxes for tax year 2009, due in September 2010 and March 2011, but did not address the abatement of taxes that had accrued thereafter up to and including the date the City acquired ownership, and, just recently the City received a notice of tax delinquency for that period which spurred questioning of the County Treasurer, who indicated that the City needed to again request the abatement of same, and
WHEREAS, The City Council finds that the best interests of the City are served by not paying said taxes, as allowed by law, and so informing the Board of Supervisors so that the taxes may formally be abated.
NOW, THEREFORE, BE IT RESOLVED by the City Council that the City Clerk is hereby directed to inform the County Treasurer of the decision of the City Council to not pay any and all taxes accrued through the City ownership of the Riddle Property (MONCO Parcel Number 0227129020), specifically those set out in a tax delinquency notice in the amount of $2,683.00 associated with the 2010 property tax year, plus any and all continuing costs and interest, if any, and to request that the County Board of Supervisors abate said taxes as required by the Iowa Code.
