IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #11-168
Resolution to approve proposed 28E Agreement and Lease Agreement Terms between the City of Monticello and the Fair and Exposition Society of Jones County, Iowa with regard to the Jones County Youth Development Center project.
WHEREAS, The City Council has previously supported the Jones County Youth Development Center by the passage of a Resolution not only providing ground for the facility, but funds and other concessions, and
WHEREAS, The project successfully received a Vision Iowa CAT Grant, putting the project in a position to begin the process of obtaining final construction bids and setting a construction schedule, and
WHEREAS, The Fair and the City have contemplated and discussed the entry into a Iowa Code Chapter 28E Agreement to cover each parties’ obligations with regard to the construction, maintenance, and operation of the new facility, and
WHEREAS, The City Administrator has previously provided a draft 28E Agreement to the City Council and staff for review, and has received comments, incorporating many if not all of the comments within the presently proposed 28E Agreement, and
WHEREAS, The Council finds that this project, and the completion of the facility, will be a positive enhancement to the community and will have a positive economic impact to the community, and
WHEREAS, The Council finds that the proposed 28E Agreement and intended Lease Agreement, for a term of fifty (50) years as outlined within the 28E Agreement is appropriate and in the best interests of the City of Monticello, and should therefore be approved.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa hereby approves the 28E Agreement as presently drafted and authorizes the Mayor to execute same on behalf of the Monticello City Council, with same to be deemed effective and of force upon the approval of same by the Fair and Exposition Society of Jones County, Iowa. The Council further authorizes the Mayor to execute a lease, on the standard Iowa Bar Association lease form, encompassing the terms and provisions contemplated by the 28E Agreement.
