RESOLUTION #11-58
Resolution to approve of the proposed Bill of Sale and Lease Agreement by and between Monticello Aviation, Inc., and the City of Monticello.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City Council previously approved the preparation of plans and specifications related to the construction of the Monticello Regional Airport Terminal Building, and
WHEREAS, the Council previously approved the use of City Federal AIP funds to compensate Snyder and Associated, the City Engineer, for purposes of Terminal Building design, and
WHEREAS, after many months of planning, the Airport Board has finalized plans for the Terminal Building and the FAA has approved the plans, finding the plans to be eligible for 95% FAA funding, with the City being responsible for the 5% cost share, and
WHEREAS, the plans determined to be most appropriate by the Airport Board include the attachment of the Terminal Building to the building currently owned by Monticello Aviation, Inc. and also housing the Airport Manager’s Office, and
WHEREAS, Monticello Aviation has agreed to sell, and the Airport Board recommends the purchase, of Monticello Aviation’s building for the sum of $110,000 including the Aviation Fuel Tank and System, the details of the purchase agreement being set our more fully in a “Bill of Sale”, a copy of same being, by this reference, incorporated herein as if same had been set forth fully verbatim herein, and
WHEREAS, The Airport Board has also negotiated the terms of a Lease Agreement with Monticello Aviation, whereby they would be entitled to lease the current site of Monticello Aviation, Inc., for a series of years, said “Lease Agreement”, by this reference, being incorporated herein as if same had been set forth fully verbatim herein, and
WHEREAS, the City Council finds, that should a bid be awarded on the Terminal Building, with said Terminal Building being constructed substantially as planned, i.e. being attached to the Monticello Aviation Building, that it is in the best interests of the City to acquire the Monticello Aviation, Inc. Building.
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 25th day of April 2010, that the purchase of the Monticello Aviation, Inc. building and Aviation Fuel System, for the sum and under the terms and conditions of the Bill of Sale and Lease Agreement as proposed, are hereby approved, subject to the Council’s approval, subsequent hereto, of a bid and entry into a contract related to the construction of the Monticello Terminal Building with a design that includes the attachment of same to the present Monticello Aviation, Inc. building, and authorizes the Mayor Pro Tem to execute said Bill of Sale and Lease Agreement after the Council has approved of a bid and awarded a contract related to the Terminal Building Construction without further action of the City Council.
