IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #12-12
Resolution to approve Entry into Agreement with Seneca Companies to
Perform Tier 1 RBCA Assessment.
WHEREAS, The City of Monticello is the owner of the property located at 615 E. Washington Street, Monticello, Iowa, former site of Riddle Manufacturing, and
WHEREAS, As owner of the property the City was responsible for the removal of an underground storage tank (UST) located at said property, and
WHEREAS, The tank was removed by Seneca pursuant to Council direction and approval with state tank removal funds reimbursing the City for said expenditure, and
WHEREAS, During the removal process it was determined that there had been a release from the UST through a small hole in the tank, said release necessitating what is referred to as a TIER 1 RBCA Assessment by State Code and related DNR regulations, and
WHEREAS, The IDNR has notified the City that we must proceed in said fashion and Seneca has provided a proposed agreement and offered assistance with the procurement of State of Iowa “Innocent Landowner Funds” to cover the costs of said assessment, and
WHEREAS, The City Administrator has prepared the “Innocent Landowner Claim Form” and will submit same upon Council approval of this Resolution, with the present understanding that we should qualify for funding from the Innocent Landowner fund, and
WHEREAS, The Council finds it appropriate to proceed with this work and finds that the proposed agreement with Seneca should be approved and the Innocent Landowner Claim Form submitted to the appropriate authority, requesting reimbursement for the project costs, currently estimated to total $7,600.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby approve the proposed agreement with Seneca Companies in the amount of $7,600 and directs the City Administrator to execute said agreement on behalf of the City Council and further directs the City Administrator to submit the Innocent Landowner Claim Form seeking full reimbursement of costs related hereto.
