THE CITY OF MONTICELLO, IOWA
RESOLUTION #12-40
Resolution to approve payment to Jones County consistent with 28E Agreement
between Jones County and the City of Monticello with regard to the
Hardscrabble Road project in the amount of $140,000.00.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City previously approved a 28E Agreement between the City and Jones County by Resolution #11-88, and
WHEREAS, The County subsequently approved same, and
WHEREAS, The 28E agreement approved by the Council and the Board of Supervisors included the following provisions:
1. The City share should be 28% as noted in the agreement, or $140,000, the amount budgeted by the City for this project, whichever is less.
2. The agreement should make clear that the project “costs” being shared do not include any engineering or construction supervision, those responsibilities and any costs related thereto being the responsibility of the county.
and
WHEREAS, the project has now been completed and a request for payment has been received from the County along with a request to reconsider or modify the terms of the previously approved 28E Agreement, providing an investment of $165,714.18, $25,714.18 above the agreed sum of $140,000, and
WHEREAS, The City Council finds that the previously approved agreement should be honored, noting that the total project cost of $591,836.37 +/- was known at the entry into the agreement by the City and the County, the increase not being tied to unknown change orders or project additions or modifications of any significance, and also recognizing that City investment in this project was agreed to by the City at the request of the County after the County had already made the decision to proceed with this project.
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 19th day of March, 2012, that the 28E Agreement related to the Hardscrabble Road project, between Jones County and the City of Monticello, should be honored, and the City Clerk is hereby authorized to see to the payment of the City share as outlined within the 28E Agreement to the County in the amount of $140,000.
