RESOLUTION #12-43
Resolution to approve Don “Red” Hughes (Hughes Garage and related properties) Voluntary Pre-Annexation Agreement.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City previously directed the City Administrator to have discussions with Don “Red” Hughes related to the annexation of his property adjacent to Birch Street / Hardscrabble Road, and
WHEREAS, Those discussions have led to the completion of an Annexation Agreement wherein terms and provisions related to the proposed annexation are set out, and
WHEREAS, The Voluntary pre-annexation agreement is the first step in the annexation process, and the Council’s agreement to the terms and conditions of the pre-annexation agreement is a condition precedent to moving forward with the formal annexation process as set out in the Iowa Code, and
WHEREAS, the Council finds the terms and provisions of the voluntary pre-annexation agreement to be fair and reasonable and that the approval of same is in the best interests of the City.
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 19th day of March, 2012, that the voluntary pre-annexation agreement between Hughes and the City of Monticello is hereby approved, the Mayor is directed to execute same on behalf of the City Council, and the City Administrator is directed to move forward with the Annexation process.
