IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #13-92
Approving Eastern Iowa Excavating Pay Request #4
related to the 2012 City of Monticello Street Repair projects.
WHEREAS, The City of Monticello, Iowa is an incorporated city within Jones County, Iowa; and
WHEREAS, Eastern Iowa Excavating has contracted with the City to perform various street repairs, said projects being generally referred to as the 2012 Street Repair Projects, and
WHEREAS, Eastern Iowa has completed the agreed upon work and has billed the City consistent with the bid unit costs at appropriate quantities, submitting their 4th pay request in the amount of $25,680.69, including retainage, and
WHEREAS, A review of the Bid Packages reveals the following, in regard to the portion or percentage of each bid package eligible for payment with TIF dollars and that portion or percentage not eligible for payment from TIF dollars, to wit:
Bid Package #3 100% TIF
Bid Package #5 100% Capital Improvement
Bid Package #6 25% Capital Improvement, 75% TIF
Bid Package #7 100% Capital Improvement
Change Order #1 100% TIF

WHEREAS, The Council finds that the pay request is supported by the work completed to date and further finds that the work was completed more than thirty (30) days ago and that the retainage should, therefore, also be released, and
WHEREAS, The Council acknowledges that some of the actual quantities exceeded, and some were less than, the original bid, and to that extent finds that in both cases, increases and decreases, that same were appropriate and should be deemed approved by this Resolution, and
WHEREAS, The City Clerk is directed to pay the balance due Eastern Iowa Excavating for the work completed based upon the above percentages from either the Capital Improvement Fund or the TIF fund, as is appropriate.
NOW THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby approve Pay Request #4, including retainage, in the amount of $25,680.69
