IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #14-203
Resolution to approve Driveway Approach / Apron Agreement between Cox and City of Monticello.
WHEREAS, Dean and Mike Cox, a/k/a Kardes, Inc., are completing the construction of a new facility near the southern interchange, at or near the intersection of S. Main Street and 190th Street, within the City limits of the City of Monticello, Iowa, and
WHEREAS, The Coxes desire to pave the approach/apron from their property line to the 190th Street pavement, through the City R.O.W., and
WHEREAS, The Coxes have agreed to the terms and provisions of a written agreement that will bind them and their successors to maintain and care for the driveway approach/apron, said agreement to be recorded with the Jones County Recorder and to run with the land, and
WHEREAS, The City Council has reviewed the terms and provisions of the proposed agreement and finds it to be in the best interests of the City and that same should, therefore, be approved.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby approve and authorize entry into the proposed driveway approach/apron agreement between the Coxes and the City and does hereby authorize the Mayor to execute the same on behalf of the City Council.
