IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION # 15-25
Resolution to approve plan related to 6th Street Ditch Project
WHEREAS, many past City Councils, and the current City Council, have long discussed the 6th Street Ditch, ownership and maintenance responsibilities, with various impacted property owners, and
WHEREAS, although the 6th Street Ditch has been an on again off again discussion for many years, the City and the property owners have never reached agreement on how to resolve the various issues related to ownership, desired improvements, the sharing, if any, of expenses, and maintenance and repairs to those areas of the ditch deemed problematic, and
WHEREAS, the Council, in approving Resolution #14-86 on August 18, 2014, approving an agreement for services with the City Engineer, expressed an intent to move forward with repairs to the ditch, and to not merely re-study the Ditch, and
WHEREAS, the Council finds that the best approach, at the present, is to move forward with the preparation of plans and specifications necessary to repair and improve the ditch consistent with necessary permitting, and to hire outside legal counsel to assist the City Administrator and City Engineer with this project.
NOW, THEREFORE, BE IT RESOLVED that the City Council, in session this 6th day of April 2015 does hereby direct the City Engineer to put together an Agreement for Services for future Council consideration and authorizes the City Administrator to hire private legal counsel to represent the City of Monticello in the pursuit of this project.
