IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION # 15-44
Resolution approving Preliminary Resolution of Necessity
related to 6th Street Ditch Reconstruction Project.
WHEREAS, the City Council has determined it appropriate to proceed with a project involving repairs and upgrades to the 6th Street Ditch, and
WHEREAS, the location of the proposed improvements shall extend from approximately the intersection of the “ditch” and N. Chestnut Street on the north/west end of the project and the intersection of the “ditch” and 4th Street on the south/east end of the project, and
WHEREAS, the project scope will generally include the removal of siltation/debris, the rebuilding and reshaping of walls, ditch bottom, placement of rip rap and engineering fabric where appropriate, grading, shaping, widening and/or deepening where appropriate, surveying and the acquisition of temporary and permanent easements for construction and maintenance, and the utilization of engineers and attorneys as is appropriate and necessary throughout the project, and
WHEREAS, the City Engineer should be and is hereby directed to work with City Staff, and Attorneys representing the City, to prepare preliminary plans and specifications, estimated total cost of the work, and a plat and schedule, and to file them with the clerk upon completion, and
WHEREAS, the Council intends to assess a portion of the permissible project costs, not to exceed 50% of the permissible project costs, to benefitting property owners, with the total assessment per property owner to be less than or equal to the legally permissible maximum of 25% of the assessed property valuation in compliance with Iowa Code §364.42(3)(a), and
WHEREAS, the properties deemed to be specially benefitted by the improvement include all of those through which the 6th Street Ditch passes, all properties lying adjacent to a lot through which the 6th Street Ditch passes, and all those located within close proximity to the Ditch that have been determined to be at least partially within the a FEMA designated flood zone, and
WHEREAS, the aforementioned project shall be known as the “6th Street Ditch Reconstruction Project”
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby approve this Preliminary Resolution of Necessity related to the 6th Street Ditch Reconstruction project and directs the City Engineer, City staff, and the attorneys hired by the City to proceed accordingly.
