IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION 15-52
Appointing Rob Paulson to fill the open Ward I Council seat and directing the publication of notice of said appointment pursuant to Iowa Code §372.13(2)(a)
WHEREAS, The City of Monticello, Iowa is an incorporated City within Jones County, Iowa; and
WHEREAS, Councilman Frank Yanda resigned his Ward I seat, creating a vacancy, and
WHEREAS, The City Council finds it appropriate to appoint Rob Paulson, a resident of Ward I to fill said open seat, and
WHEREAS, The Council finds that the open term will expire at the end of the year and that there will be an election in November of this year to fill that seat for the next four year term, commencing on or about January 2, 2016, and that it makes no financial sense to spend money on an election this summer and again in November, and
WHEREAS, The following notice shall be published in the Monticello Express as required by law:
Pursuant to Iowa Code section 372.13(2)(a) the Monticello City Council has filled the Council Ward I vacancy by appointment at its Regular City Council meeting on June 1, 2015. Under this code section the electors of Ward I in the City of Monticello have the right to file a petition requesting the vacancy be filled by election. The petition must contain the signatures and addresses of at least 10 eligible electors of Ward I in the City of Monticello, and be filed with the City Clerk no later than fourteen (14) days after the date of this publication. If such petition is filed as prescribed by Iowa law, the appointment shall be temporary until the results of the special election are canvassed, and the successful candidate is duly qualified.
NOW THEREFORE, BE IT RESOLVED that this City Council of Monticello, Iowa does hereby appoint Rob Paulson to fill the vacant Ward I Council Seat and further directs the City Clerk to publication of the notice previously set forth herein.
