Resolution 15-58

The City of Monticello, Iowa

IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA

RESOLUTION # 15-58

Resolution directing the City Administrator to commence the Severance process related to the proposed severance of Shover and Kraus owned property lying east of US Highway 151 and north of State Highway 38, with the condition that Shover and Kraus enter an agreement with City, that will run with the land, that they, their assigns and/or successors in interest will not spread any manure on agricultural property owned by them within the Monticello City limits without prior written permission of the City Council.

 

WHEREAS, the City Council was made aware of the erection and use of a cattle feed lot within the City limits on property zoned A-1, Agricultural, and the erection of other buildings that were built without City building permits, all in violation of the current City Code, and

 

WHEREAS, after significant discussion at various public meetings the Council has found it appropriate to take action that will allow the continuation of the cattle feed lot and limit the spreading of manure on other agricultural zoned properties owned by the parties that would continue to be located within the City limits, and

 

WHEREAS, the City Council finds it to be in the best interests of the City to move forward with the legal severance of the Shover and Kraus properties lying east of US Highway 151 with the understanding that Shover and Kraus will be responsible for all costs related to surveying, legal costs, fees, or expenses related to the severance, and

 

WHEREAS, it is further found that there are a couple of adjacent properties that should be considered for severance if the severance of the Kraus and Shover properties move forward, those including a Nagel parcel(s) and a parcel owned by the Historical Society, a designated “prairie”, and the City Administrator shall contact said property owners to gauge their interest in severance as he moves forward with the severance process.

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby direct the City Administrator to begin the process of putting together paperwork necessary to sever the properties lying east of US Highway 151 and owned by Kraus and Shover in addition to parcels owned by Nagel and the Historical Society, said severance to also involve and be subject to the severance of all roads serving said properties.

 

IN TESTIMONY WHEREOF, I have hereunto subscribed my name and caused the Great Seal of the City of Monticello, Iowa to be affixed hereto. Done this 15th day of June, 2015.
