RESOLUTION #16-107
To approve Parking Improvement Agreement between
The City of Monticello and Tin Roof, LLC
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City of Monticello previously approved a site plan related to improvements on Lot 3 of Yeoman’s 3rd Addition to Monticello, Iowa and authorized the issuance of a building permit, waiving certain City Code requirements related to parking improvements due to the fact that the building to be erected, while a commercial building, was going to be used for personal not commercial purposes, and
WHEREAS, The Council approved the waiver of said parking improvement requirements with the understanding that said improvements would be required should the use of the property ever convert from personal to commercial and directed that an agreement be prepared to that end, and
WHEREAS, the Council has been presented with an agreement entitled “Parking Improvement Agreement”, has been informed and understands that Tin Roof, LLC has reviewed and is agreeable to the terms of the agreement, and finds same to be agreeable and in the best interests of the City of Monticello
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 7th day of November, 2016, that the Parking Improvement Agreement between the City of Monticello and Tin Roof, LLC is hereby approved and the Mayor is authorized to execute same on behalf of the City Council.
