RESOLUTION #16-73
To approve proposed storm water cost share agreement between
The City of Monticello and LeeRoy and Jan Mootz, Citizens State Bank, and Herky Hawk Financial Corp.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City of Monticello previously enacted a storm water management ordinance to be used by the City for City storm water related purposes, and/or to be used as a cost share with private property owners on storm water related projects, and
WHEREAS, The City Ordinance provides that the City contribution in a private project may not exceed 50% of that project cost, and
WHEREAS, certain property owned by LeeRoy and Jan Mootz, Citizens State Bank, and Herky Hawk Financial Corp, and utilized by other adjacent building owners, is used as a parking lot and rear building access for a number of commercial buildings, with access off of Grand Street, and
WHEREAS, The property owners and users have requested that the City Council approve a 50/50 cost share on a portion of the project which includes the installation of a catch basin and piping to take water from the parking lot area to the City Storm Sewer and further requests that the City cover 100% of the costs related to the removal and installation of new curb and gutter along the north side of Grand Street, between the intersection of Grand and the project area, and
WHEREAS, The property owners / users will, with the participation of the City as noted above, agree to the removal and installation of a new parking lot and new sidewalk as is necessary as part of this project, and
WHEREAS, The Council finds that participation in the curb and gutter removal and replacement and the installation of the proposed catch basin is appropriate and consistent with the considerations set out in the City Code, and authorizes the City Administrator to put together a written agreement to cover up to and not to exceed 50% of the costs of the storm sewer parking lot catch basin and piping to the City Storm Sewer Catch Basin at the NW corner of S. Cedar and Grand Street and to cover 100% of the costs related to the removal and re-installation of curb and gutter from the NW corner of S. Cedar and Grand Street, in a westerly direction, to the project location, with maximum City investment not to exceed $7,165.00, said investment to not be paid until the entirety of the parking lot, curb and gutter, and drainage project is complete.
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 6th day of June, 2016, does hereby approve the request for City storm water cost share, and agrees to invest those amounts noted herein in an amount not to exceed $7,165.00, same to be paid upon final project completion and invoicing, and directs the City Administrator to draft an agreement to be signed by all necessary parties consistent with the determinations and direction of the Council as set forth within the above and foregoing Resolution.
