IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #18-65
Resolution to recognize the past vacation of R.O.W. and to authorize the execution and delivery of Quit Claim Deed to adjacent property owner, The Vera Fae Schoon Estate
WHEREAS, The Jones County Board of Supervisors previously vacated certain road Right-of-Way, said action being recorded in Supervisors’ Record Book A, Page 54, dated January 8, 1962, the area so vacated being described by the following legal description, created and/or approved by the County Auditor so that said ROW may now be transferred to the adjacent property owner, the transfer of same failing to have occurred at the time of vacation:
Excess road right of way from County Road Project #4725 described as:
That part of the right of way of the former Monticello Prairieburg Road lying northerly of Parcel E (recorded at Book 360 page 202, and in Plat Book K, page 156), and southerly of the north right of way line of the former Monticello Prairieburg Road prior to County Road Project #4725, in the NW ¼ NW ¼ of Section 28-T86N-R3 and in the SW ¼ SW ¼ of Section 21-T86N-R3, and as further described on Attachment A (Excess ROW Plat Proj. No. RS-4725), and in City of Monticello Resolution 94-24, except any portions that may lie within Auditor’s Plat No. 11.

WHEREAS, The current adjacent property owner is The Vera Fae Schoon Estate and that the family prefers that the vacated ROW be transferred to said estate, and
WHEREAS, The City Council finds that the City should approve of the transfer of said vacated right-of-way to the current adjacent property owner, the Vera Fae Schoon Estate.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby recognize the past vacation of the aforementioned R.O.W. and authorizes the preparation, execution, and delivery of a Quit Claim Deed to the Vera Fae Schoon Estate as noted previously herein, to clear up any current or potential future title issues.
