The City of Monticello, Iowa
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION # 19-147
Accepting Dedication of portion of John Drive and public improvements located within the right-of-way thereof same being identified as Parcel 2019-72 by a Plat of Survey dated 10/16/2019 prepared by Licensed Land Surveyor William H. Burger.
WHEREAS, The City of Monticello, Iowa is an incorporated City within Jones County, Iowa; and
WHEREAS, The City Council approved the Plat of Survey to Parcel 2019-72, by Resolution #19-146, said parcel being created to allow for the dedication of City street and other infrastructure improvements located therein that were not dedicated at the installation thereof many years ago as should have occurred, and
WHEREAS, The Council further finds that the Parcel 2019-72 is 35’ wide, 5’ wider than the surrounding ROW areas due to the fact that the water and fire hydrants, specifically, were found to be outside of the normal 30’ wide ROW dedication by a foot or two, and
WHEREAS, The Council finds that because the ROW adjacent to Parcel 2019-74 and 2019-75 will be 5’ wider than normal for that area that it would be appropriate to reduce the minimum front yard setback for construction on those parcels by 5’, from 30’ to 25’, and
WHEREAS, The Council finds that the street and other infrastructure improvements including water main, hydrants, valves, sanitary main, and storm sewer improvements have been utilized by the public for many years and maintained by the City, and
WHEREAS, The Council finds that the owners of the property have executed a formal Dedication of said parcel, a copy of same being appended hereto, and
WHEREAS, The Council finds, based upon the above and foregoing, that the proposed dedication of those public improvements should be accepted, said public improvements to be maintained and preserved by the City of Monticello for the use, enjoyment, and benefit of the citizens of Monticello.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby accept the dedication of the property identified by the Plat of Survey to Parcel 2019-72 as described within the body of this Resolution, and due to the additional 5’ in width of the right-of-way to include City infrastructure unintentionally placed on private property does hereby approve a reduced front yard setback for Parcels 2019-73 and 2019-74, from 30’ to 25’. The Clerk is directed to record this Resolution and attached dedication.
