RESOLUTION # 2026-3

Approving Plat of Survey to Parcel 2026-01, Parcel 2026-02, and

Lot A, and accepting the Dedication of Lot A

WHEREAS,  The City Council has been presented with the Plat of Survey to Parcel 2026-01, 2026-02, and Lot A, all located within the City limits of the City of Monticello, Iowa; and

WHEREAS,    Peggy S. Rickels, owner of the parcels set forth in the above referenced Plat of Survey, had the survey prepared to clear up issues related to property lines, a portion of the property having previously been railroad right of way, with Lot A being located in what is known as Buckeye Street and Cedar Street, used by the public as if same was dedicated and accepted City right of way, same having been maintained as such by the City for many years, Peggy Rickels intending to dedicate and transfer Lot A to the City of Monticello, and

WHEREAS,   The City Council has been informed that the Planning & Zoning Commission has reviewed the Plat of Survey and recommended that the City Council approve same, accepting the dedication of Lot A by the owner, same to be transferred to the City by Quit Claim Deed, and

WHEREAS,   The Council finds that the Plat of Survey should be approved and that the City should accept the dedication of Lot A to the City, same to be transferred to the City by Quit Claim Deed, said Deed to be prepared by the City and recorded by the City, at City cost, upon execution.

NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby approve the Plat of Survey to Parcel 2026-01, Parcel 2026-02, and Lot A, and hereby agrees to accept the Dedication of Lot A to the City as public right of way, for public use, with Lot A to be transferred to the City by Quit Claim Deed to be prepared by the City, and after execution by the owner recorded at City expense.

IN TESTIMONY WHEREOF, I have hereunto subscribed my name and caused the Great Seal for the City of Monticello, Iowa to be affixed.  Done this 5th day of January, 2026.
