RESOLUTION # 10-102
Approving and authorizing Payment to Jones County of City of Monticello share of Amber Road Bridge a/k/a Kitty Creek Bridge project.
WHEREAS, The City of Monticello and Jones County agreed to join as partners on the replacement of the bridge spanning Kitty Creek on the Amber Road Bridge, and
WHEREAS, The City share of the bridge replacement project, not including any engineering, totals $34,248.94, and
WHEREAS, The records, and/or history of the project suggest some lack of clarity with regard to the City’s agreement to share in the engineering costs and expenses related to this project, said engineering having been performed by the County Engineer’s Office, and
WHEREAS, The County has requested that the City share in the engineering costs and expenses in the amount of $20,956.96, and
WHEREAS, The City finds that the Engineering costs and expenses can be divided, to some extent, into two categories, those that represent out of pocket type costs to the engineer’s office and those that represent the in-kind efforts of the Engineer and his staff, and
WHEREAS, The City finds that the 28E Agreement entered into and approved by the parties does not require the City to share in any of the Engineering costs and/or expenses, but finds that it would be appropriate and just for the City to share in one-half of the “costs”, in the amount of $7,455.70 and to further pay the sum of $13,501.26 towards the efforts of the Engineer and his staff, for a total payment to the County in the amount of $55,205.90.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Monticello, Iowa, that the City Clerk is hereby directed to make payment to Jones County in the amount of $55,205.90, said payment to be made to the County at the address and to the appropriate County Department as directed by the County Engineer and County Auditor.
