THE CITY OF MONTICELLO, IOWA
RESOLUTION #10-140
Approving Payment related to agreement between City of Monticello and Bob Faust associated with storm water management cost share.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City of Monticello previously enacted a storm water management ordinance to be used by the City for City storm water related purposes, and/or to be used as a cost share with private property owners on storm water related projects, and
WHEREAS, The City previously agreed to share in an eligible private project with Bob Faust and Bob Faust has requested that the City make payment to his contractor consistent with said agreement, and
WHEREAS, Bob Faust requests payment from the City in the amount of $37,232.19, and
WHEREAS, The City Council has expended engineering fees related to this project, and pursuant to said agreement the amount payable to Faust is to be reduced by one-half of the engineering fees so paid, said fees paid to date in the amount of $3,688.50 (1/2 = $1,844.25), and
WHEREAS, The City has accrued additional engineering fees not yet paid, however, the remaining engineering fees can be deducted from the final city payment on this project which will come after the spillway / overflow structure is complete, and
WHEREAS, The Council finds it appropriate to pay Faust, under the terms of the agreement, the sum of $ 35,387.94 at this time.
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 15th day of November 2010, that it is appropriate for the City to pay $ 35,387.94 to Bob Faust consistent with the agreement between the City and Bob Faust under, and consistent with the City of Monticello Storm Water Management Ordinance.
