Resolution 10-86

RESOLUTION #10-86

Resolution finding the property and structures located at 215 E. 4th Street to be in violation of Monticello Code of Ordinances Chapter 50 “Nuisances”, Chapter 145 “Dangerous Buildings” and Chapter 153 “Property Maintenance”, and further finding that said structures should be condemned with the City Administrator
being directed to take immediate steps to begin the process of pursuing
the demolition of said structures.

WHEREAS, the City of Monticello served the owner of 215 E. 4th Street with a Notice to Abate, same being mailed on May 6, 2010 and received by Curt Kass on May 10, 2010, same providing a seven (7) day window within which to commence repairs / remedies, and a ninety (90) day period within which to complete the necessary repairs / remedies, and

WHEREAS, After Curt Kass’ receipt of the Notice to Abate, he visited with the City Administrator, Doug Herman, and agreed to have the home sided and the balance of the home exterior brought into compliance within thirty (30) days, and

WHEREAS, It does not appear as of the consideration of this Resolution that Mr. Kass has taken any steps whatsoever to address the condition of the home, and

WHEREAS, This property has been in a deficient condition, and in violation of the Code of Ordinances for a number of years, and there have been nuisance issues addressed at this property related to junk machinery, long grass, and other debris in the yard during said years, and

WHEREAS, the Council finds that prior action of the City has failed to bring about compliance by Mr. Kass with the local Ordinances, and that his failure to comply, and the continued condition of his property in violation of the Monticello Code of Ordinances has a strong negative impact on neighboring property values, and that the best remaining course of action to be taken by the City Council is to pursue the abatement, by demolition, of the structures located on said property.

NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby find the property and structures located at 215 E. 4th Street to be in violation of Monticello Code of Ordinances Chapter 50 “Nuisances”, Chapter 145 “Dangerous Buildings” and Chapter 153 “Property Maintenance”, does hereby condemn said structures, and directs the City Administrator to take immediate steps to begin the process of having the structures demolished.
