IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION # 11- 83
Approving purchase of Tax Sale Certificates from Clay Gavin and
OHP6 a/k/a Oak Helm Partners
WHEREAS, The City of Monticello has by Resolution of the Council and receipt of a Deed, accepted ownership of the Riddle Mfg. property, and
WHEREAS, The Council is aware the that property is subject to two tax sale liens, one in favor of Clay Gavin, Certificate #09094, with a present amount due totaling $3,875 and OHP6, Certificate #10086, with a present amount due totaling $6,785, and
WHEREAS, The Council has been informed that Gavin will assign his Tax Sale Certificate to the City in return for the payment of $3,100 and that OHP6 will assign its’ Tax Sale Certificate to the City in return for the payment of $6,000, and
WHEREAS, The Council finds it to be in the best interests of the City to obtain clear title to the Riddle property as part of the overall plan to reclaim flood plain and floodway property in this area of the community, along Kitty Creek, for future green-space and park related improvements.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of Monticello, Iowa does hereby authorize and direct the City Administrator to see to the payments as negotiated by the City Administrator with the Certificate Holders as previously outlined herein, and to obtain the tax sale certificates by assignment from Clay Gavin and OHP6 (Oak Helm Partners).
