IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #11-93
Resolution to approve Site Plan related to proposed building
on Lot 3, Yeoman’s 3rd Addition.
WHEREAS, Joe Oswald has presented a Site Plan related to a building proposed to be built on Lot 3 of Yeoman’s 3rd Addition, and
WHEREAS, The City Planning and Zoning Board has reviewed the site plan as prepared and has recommended its’ approval to the Council, and
WHEREAS, The Planning and Zoning Board also recommends that the Council waive the requirement that parking stalls be installed immediately due to the fact that the proposed structure will be for the personal use of Mr. Oswald, with the understanding that an agreement would be entered between the City and Oswald setting out his, and/or his successors, obligation to install parking deemed necessary by the P & Z and City Council at such time as the building is used for commercial or industrial purposes, and
WHEREAS, The City Council has considered the Site Plan and the comments and recommendations of the P & Z and finds that the Site Plan should be approved, with direction to the City Administrator to enter into a written agreement with Oswald setting out his and/or his successors responsibilities with regard to “parking”, consistent with the recommendation of the Planning and Zoning Board, said agreement to be brought to the council for approval, and to thereafter be recorded with the City Resolution approving same.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby approve of the Site Plan to Lot 3 of Yeoman’s 3rd Addition, with the understanding that an agreement between the City and Oswald will be prepared and approved by the Council noting the Council’s agreement to waive the “parking” requirements until such time as the property is used for commercial or industrial purposes, at which time the site plan shall be reviewed and a decision made on how many and what types of parking will then be required.
