RESOLUTION #13-38
Approving Pay Request to Ricklefs Excavating, Ltd., related to
Walnut Street Sewer Repair project, with understanding
that City will withhold $1,000 retainage.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City of Monticello previously entered into an agreement with Ricklefs Excavating to see to certain repairs to a sanitary sewer line running generally parallel and west of Walnut Street, in a field behind the homes located on the west side of Walnut Street, and
WHEREAS, The project has been substantially complete, with the only work remaining being the restoration of disturbed grounds, and
WHEREAS, The pay request in the amount of $26,259 is below the project bid amount and would represent “full payment” for this project, and
WHEREAS, the City Administrator recommends that $1,000 be retained from the final payment until the restoration work has been completed, with the Resolution further providing that the retainage could be paid to the contractor as soon as the P.W. Director determines that satisfactory restoration has occurred, without further Council approval, videotaping to be completed by contractor or city.
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 15th day of April 2013, that the pay request from Ricklefs Excavating in the amount of $26,259 should be approved for payment with the understanding that $1,000 will be held as retainage by the City until such time that the grounds in and around the project area have been fully restored by the contractor to the satisfaction of the Monticello P.W. Director, at which time the $1,000 retainage may be paid to the Contractor without further Council consideration or approval.
