Resolution 14-82

The City of Monticello, Iowa

IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA

RESOLUTION # 14-82

Resolution to approve sale of City owned property to Tony and Stacy White, same being a part of property formerly known as the Monticello Machine Shop located at 608 E. Washington Street, being approximately 50’ in width and 240’ in length

 

WHEREAS, the City Council published notice of a Public Hearing to consider the possible transfer of a 50’ wide strip of property to Tony and Stacy White, same being located adjacent to the White property and part of the property formerly known as the Monticello Machine Shop, located at 608 E. Washington Street, and

 

WHEREAS, the Public Hearing was held on August 18, 2014 at 6:00 p.m., and

 

WHEREAS, after the Public Hearing the Council discussed the proposed transfer, finding that the transfer of said property for $5,000 was appropriate and in the best interests of the City and the Whites, resulting in compliance with City setbacks and putting the Whites in the position to legally construct additions or new buildings on said property while meeting setbacks, said compliance and potential development being in the best interest of the City, further finding that the reduction of the City owned green space by said 50’ x 240’ parcel will not have a negative impact on the green space, and

 

WHEREAS, the Council finds that the City Administrator can prepare all documents necessary to transfer the property and should do so at no cost to the Whites, but that the City will not provide an updated abstract to the property to the Whites, allowing the Whites to review the current abstract and pay for an update of that abstract if they choose to do so at their cost, returning said abstract to the City after said review, and

 

WHEREAS, the Council further confirms that the Whites are aware of the covenants associated with said property, specifically, that no permanent improvements can be constructed or placed on the property, said restrictions being a requirement of the FEMA supported purchase of said property.

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby direct the City Administrator to see to the sale and transfer of said parcel to the Whites for the sum of $5,000.

 

IN TESTIMONY WHEREOF, I have hereunto subscribed my name and caused the Great Seal of the City of Monticello, Iowa to be affixed hereto. Done this 18th day of August, 2014.
