The City of Monticello, Iowa
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION # 15-46
Rescinding the prior agreement between the City and Officer Brian Tate that
required residence within City limits and further authorized Police Chief Smith to
prepare a residency policy for Council approval
WHEREAS, the City of Monticello and Monticello Police Officer Brian Tate entered into an agreement at the hiring of Tate that required Tate to maintain residency within the City limits of the City of Monticello, and
WHEREAS, Officer Tate requested that said restriction be lifted and after discussions with Police Chief Smith, Chief Smith has recommended that the Council approve of the provision that Officer Tate reside within the City limits and specifically authorize him to live outside the City limits so long as his primary residence remained within fifteen (15) miles by road travel, not as the “crow flies”, of the Monticello Police Department, and
WHEREAS, the City Council finds that a fifteen mile restriction is appropriate and in the best interests of the Community, and that a residency restriction of fifteen miles for Police Officers is appropriate as it is imperative for all officers, even those off duty, to be in a position to respond quickly to emergent situations in the community if and when they may arise.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby approve of the amendment to the prior agreement between the City of Monticello and Monticello Police Officer Brian Tate, allowing Officer Tate to live outside the Monticello City limits, but within fifteen (15) miles of the Monticello Police Department as noted previously herein.
