IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #16-13
To Approve a 50% Cost Share related to the relocation of Sewer main
running accompanied by the grant by Intlekofer to the City of a permanent
easement through Adam Intlekofer property
WHEREAS, Adam Intlekofer approached the City with the desire to erect a 50’ x 200’ building on property owned by Intlekofer along 11th Street, in Monticello, Iowa, and
WHEREAS, The City Planning and Zoning Board had first reviewed the request based upon the fact that a City Sewer Main was located on and across the Intlekofer property, which used to be utilized as Railroad Right of Way, and Intlekofer wished to build over top of the Sewer Main, and
WHEREAS, The Planning and Zoning Board recommended that the building not be built over a City sewer main, that the main be moved before any building occurred, and
WHEREAS, The City Council considered Intlekofer’s desires to proceed with the plan to build over the sewer main or for the City to pay the costs related to the movement of the main, and determined it appropriate to proceed with a cost share, where Intlekofer and the City would each pay 50% of the costs related to the sewer main relocation project with the understanding that Intlekofer would grant the City a permanent written utility easement.
NOW THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby approve a 50/50 cost share with regard to the relocation of the sewer main crossing a portion of the Intlekofer property with the understanding that Intlekofer will grant the City all necessary utility easements and that the cost share, plan, and easement are all put in writing and approved prior to the project proceeding.
