RESOLUTION #16-74
To approve proposed storm water cost share agreement between
The City of Monticello and Jerald and Sherry Behrends
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City of Monticello previously enacted a storm water management ordinance to be used by the City for City storm water related purposes, and/or to be used as a cost share with private property owners on storm water related projects, and
WHEREAS, The City Ordinance provides that the City contribution in a private project may not exceed 50% of that project cost, and
WHEREAS, there is an open storm water conveyance, previously being adjacent to a railway line, on property owned by Jerald and Sherry Behrends, and
WHEREAS, The property owners have requested that the City share in the costs of the enclosure of said conveyance/ditch under the City Storm Water management Ordinance, and
WHEREAS, The City understands that the property owner has obtained a bid of approximately $4,000 to enclose the ditch, utilizing a two-walled 24” plastic pipe, same being cemented into the existing culverts at each end of the existing ditch, and
WHEREAS, The bid received by Behrends contemplates that most of the fill necessary to cover the pipe will be made available from the S. Street reconstruction project at no cost to the project, with the understanding that there will be little to no black dirt made available, merely miscellaneous materials collected and/or removed during the S. Street project, and
WHEREAS, The City Council agreed to see to the connection of the Dr. James dental building downspouts and sump pump, that currently dump into the open ditch, to any pipe that would be installed in the Behrends ditch under a cost share agreement with the City, at no cost to James and
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 6th day of June, 2016, does hereby approve the request for City storm water cost share, and agrees to invest in said project at the rate of 50% of total costs not to exceed $3,800.00 and to provide miscellaneous fill for said area (not necessarily black dirt) at no cost to the project, and further directs, that the existing downspouts and sump pump piping to the open ditch shall be installed/connected to the 24” pipe to be installed in the open ditch, the City share to be paid upon final project completion and invoicing, and directs the City Administrator to draft an agreement to be signed by Behrends with the determinations and direction of the Council as set forth within the above and foregoing Resolution.
