IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #16-82
Resolution to Repeal and Terminate the 28E Agreement between the City of Monticello and the Jones County Economic Development Commission and to approve a Memorandum of Understanding between said entities.
Whereas, the City Council of the City of Monticello passed a resolution in 1998 that established the Jones County Economic Development Commission, and
Whereas, the Jones County Economic Development Commission was later established as a non- profit corporation and was obtained a 501 (c )(6) designation from the Internal Revenue Service (IRS), and
Whereas, the Board of Directors of the Jones County Economic Development Commission and the City Council of the City of Monticello have determined that the 28E Agreement adopted in 1998 serves no continuing purpose and that it is in the best interest of both entities to terminate said agreement, and
Whereas, a proposed Memorandum of Understanding (MOU) has been proposed for consideration and approval by the City, said MOU intended to set forth the basic elements of the relationship between the JCED and the City of Monticello, and
Whereas, The City Council finds it appropriate to enter into a MOU with JCED and finds the terms and provisions of the MOU as amended by the City Administrator to be appropriate and in the best interests of the City of Monticello.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby repeal and terminate the Jones County Economic Development 28E Agreement previously adopted in 1998 as allowed by Section 8 said 28E Agreement, and does hereby approve the Memorandum of Understanding between the parties, a copy of same to be appended hereto, and authorizes the Mayor and City Administrator to execute same on behalf of the City Council.
