RESOLUTION #09-146
Resolution to approve Voluntary Annexation Request.
WHEREAS, City employee Dan Jacobs in interested in buying real estate presently lying adjacent to the city limits of the City of Monticello, and
WHEREAS, Dan Jacobs only desires to buy said property if the City will agree to annex the property, and
WHEREAS, Dan Jacobs recognizes and understands that the City will not now, or hereafter, be under any obligation to extend services to this property, and could not be obligated to by Mr. Jacobs or by any successor in interest, and
WHEREAS, An Annexation Agreement will be drawn up to be signed by Dan Jacobs and any other property owners, to ensure that all terms are agreed to in writing and of record, and
WHEREAS, The City Council finds that it would not be at all prejudiced by the annexation of this property and that the request of Dan Jacobs should be granted.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby approve of the annexation of the property located at 19619 144th Ave., Monticello, IA 52310, said annexation being subject to the completion and execution of an annexation agreement by the property owners and the City consistent with the prior provisions hereof, said annexation agreement being subject to final approval by the Council upon completion and execution of same.
