RESOLUTION #10-45
Resolution to approve of release of City Atty. Anne Loomis “summary” report, directed by Council to be prepared at March 15, 2010 Mtg.
WHEREAS, the City Council previously received a report from City Atty. Anne Loomis after the conclusion of an investigation she was directed to undertake by the Monticello City Council, and
WHEREAS, the Council has been made aware that it can maintain the confidentiality of the document by asserting attorney-client privilege, but that it can release the document as a public document if it chooses to waive that privilege so long as the name of the “complainant” can be excluded from the report, and
WHEREAS, The City Council considered this issue at the regular council meeting of March 15, 2010, and as a result thereof directed the City Attorney to prepare a summary report of her findings that protected the identity of the complainant, and
WHEREAS, The City Attorney has prepared such report and the Council has had an opportunity to review the same, and finds that same should be approved for release.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby authorize the public release of City Attorney Anne Loomis’ “Summary Report” dated March 23, 2010, and specifically directs that a copy of same be provided to the Monticello Express in response to their open records request.
