SET DATE FOR HEARING ON EXPANDED URBAN RENEWAL AREA DESIGNATION AND URBAN RENEWAL PLAN AMENDMENT

The Council of the City of Monticello, Iowa, met on May 2, 2011, at 6:00 o’clock, p.m., at the Mary Lovell LeVan, Monticello Renaissance Center, Community Media Center, 220 East First Street, in the City, for the purpose of setting a date for a public hearing on the designation of an expanded urban renewal area. The Mayor Pro Tem presided and the roll being called, the following members of the Council were present and absent:
Present: Dave Goedken, Gerald Muller, Gregg Merfeld, John Sauser, Chris Lux and Tom Yeoman.
Absent: None.
The Mayor Pro Tem announced that an amendment to the boundaries of the Monticello Urban Renewal Area had been prepared and that it was now necessary to set a date for a public hearing on the proposed amended area. Accordingly, Council Member Goedken moved the adoption of the following resolution entitled “Scheduling Public Hearing on the proposed Amendments to the Monticello Urban Renewal Area and the Urban Renewal Plan,” and the motion was seconded by Council Member Muller. Following due consideration, the Mayor Pro Tem put the question on the motion and the roll being called, the following named Council Members voted:
Ayes: Goedken, Muller, Merfeld, Lux, Yeoman and Sauser.
Nays: None.
Whereupon, the Mayor Pro Tem declared the resolution duly adopted as follows:
RESOLUTION NO. 11-64
Scheduling Public Hearing on the proposed Amendments to the Monticello Urban Renewal Area and the Monticello Urban Renewal Plan.
WHEREAS, this Council by resolution previously created the Monticello Urban Renewal Area (the “Urban Renewal Area”); and
WHEREAS, a proposal has been made which shows the desirability of expanding the Urban Renewal Area to add and include all the property within the legal description set out in Exhibit A; and
WHEREAS, this Council is desirous of obtaining as much information as possible from the residents of the City before making this decision and it is now necessary that a date be set for a public hearing on the designation of the expanded area.;
NOW, THEREFORE, Be It Resolved by the City Council of the City of Monticello, Iowa, as follows:
Section 1. This Council will meet at the Mary Lovell LeVan, Monticello Renaissance Center, Community Media Center, 220 East First Street, Monticello, Iowa, on the 6th day of June, 2011, at 6:00 o’clock p.m., at which time and place it will hold a public hearing on the designation of the expanded Urban Renewal Area described in the preamble hereof.
Section 2. The City Clerk shall publish notice of said hearing, the same being in the form attached hereto, which publication shall be made in a legal newspaper of general circulation in Monticello, which publication shall be not less than four (4) nor more than twenty (20) days before the date set for hearing.
Section 3. Pursuant to Section 403.5 of the Code of Iowa, the City Clerk and the City Administrator are hereby designated as the City’s representatives in connection with the consultation process which is required under that section of the urban renewal law.
Section 4. The proposed urban renewal plan amendment is hereby submitted to the City’s Planning and Zoning Commission for review and recommendations, as required by Section 403.5, Code of Iowa.

NOTICE OF PUBLIC HEARING ON DESIGNATION OF EXPANDED AND AMENDED MONTICELLO URBAN RENEWAL AREA
Notice Is Hereby Given: That at 6:00 o’clock p.m., at the Mary Lovell LeVan, Monticello Renaissance Center, Community Media Center, 220 East First Street, Monticello, Iowa, on the 6th day of June, 2011, there will be conducted a public hearing on the question of designating an expanded Monticello Urban Renewal Area, pursuant to Chapter 403, Code of Iowa, by adding and including the property generally described as follows:
The John McDonald Hospital building property located at 818 W. 1st Street, Monticello, Iowa, legally described as follows:
PARCEL E, located in the SE ¼ SW ¼ of SECTION 21, TOWNSHIP 86 NORTH, RANGE 3 West of the 5th P.M., as shown in the PLAT OF SURVEY recorded in PLAT BOOK J, PAGE 104 (and in BOOK 314, PAGE 181) of the Jones County, Iowa records, containing 2.14 acres, inclusive of 0.02 acre public highway.
SUBJECT TO the rights of the public in all highways, and to all easements and agreements of record.

The Innovative Ag. Services property located at 2010 S. Main Street, Monticello, Iowa, legally described as follows:
That portion of the SE ¼ of SECTION 33, TOWNSHIP 86, NORTH, RANGE 3, West of the 5th P.M., Jones County, Iowa, described as Commencing at a point 573.1 feet North of the Southeast corner of said Section 33; thence South 8935’ West 986.0 feet to the Easterly right of way line of former U.S. Highway No. 151; thence North 4754’ East 1,328.8 feet along said right of way line to the East line of the NE ¼ SE ¼ of said Section 33; thence South 883.7 feet along the East line of said Section 33 to the point of beginning. The East line of said Section 33 is assumed to bear due North and South.
The proposed amendment to the urban renewal area brings the property described above under the plan and makes it subject to the provisions of the plan.
At said hearing any interested person may file written objections or comments and may be heard orally with respect to the subject matters of the hearing.
