The City of Monticello, Iowa
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION # 11-68
Approving and directing City Administrator to accept ownership of the Riddle Building, by the acceptance of a Deed from Gene Riddle, and directing the City Clerk to see to the recordation of said Deed with the Jones County Recorder.
WHEREAS, The City of Monticello has been working with Gene Riddle, the IDNR and the EPA in regard to the clean-up and redevelopment of the Riddle Inc. Industrial property site, and
WHEREAS, The EPA has completed the removal of contaminated waste from the property and the property is, therefore, ready for asbestos removal, according to an inspection and project design prepared by Ames Environmental, and
WHEREAS, The City has negotiated the terms of a grant with the IDNR providing for the sharing of asbestos abatement costs with the City, but before said costs can be shared the City must own the property, and
WHEREAS, The City acknowledges the existence of prior tax sale liens on the property and an EPA Superfund Lien, and understands that its’ title will be subject to these liens, and
WHEREAS, The City finds the continued presence of the Riddle property will be harmful to the environment, with the continued deterioration of the asbestos containing roof structure, contaminating the air and the materials located in the structure, and
WHEREAS, the Riddle Building is also believed to be a dam of sorts to Kitty Creek flood waters, backing up water onto and/or into the Julin Printing property and others.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of Monticello, Iowa does hereby approve of the acceptance of a deed to the Riddle Inc. property from Gene Riddle, and directs the City Clerk to see to the recordation of said deed with the Jones County Recorder.
