IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION # 12-128
Approving settlement of Judgment with Nationwide Advantage Mortgage Company for the sum of $8,000 with the additional agreement to list the property they own at 301 Third Street Monticello with a local realtor.
WHEREAS, The City previously obtained a nuisance related civil judgment against Nationwide Advantage Mortgage Company (hereinafter referred to as Nationwide) on November 18, 2011 in the amount of $3,500 plus the weekly accruing amount of $250.00, until Nationwide certified to the Court that the nuisance no longer existed, and
WHEREAS, Nationwide never certified the abatement of the Nuisance to the Court, however, the home which constituted the nuisance was demolished at the request of the City near the end of December, 2011, and
WHEREAS, Nationwide has agreed to pay the City of Monticello the sum of $8,000 in return for the release of said judgment and has further agreed to immediately list the lot located at 301 Third Street for sale with a local realtor, and
WHEREAS, The City Council finds that the proposed agreement is in the best interests of the City and that the City Administrator should execute and deliver a Judgment Release to Nationwide as proposed and agreed in conjunction with the delivery of a check to the City of Monticello in the amount of $8,000.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby approve of the preparation and delivery of a Judgment Release as proposed, and directs the City Administrator to deliver said Release to Nationwide in conjunction with the delivery of a check from Nationwide to the City in the amount of $8,000 with a signed copy of a listing agreement related to the property at 301 Third Street with a local realtor.
