RESOLUTION #12- 38
Approving Storm Water Management cost share between
The City of Monticello and Jones County Fair.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City of Monticello previously enacted a storm water management ordinance to be used by the City for City storm water related purposes, and/or to be used as a cost share with private property owners on storm water related projects, and
WHEREAS, The City Ordinance provides that the City contribution in a private project may not exceed 50% of that project cost, and
WHEREAS, The Great Jones County Fair and Food Fest has requested cost share on a tiling and re-grading project on ten (10) acres of ground owned by the Fair just north of the Fairgrounds, same to be used primarily for campground purposes during the Fair, and
WHEREAS, The Council finds that water from N. Maple Street empties into the ditch adjacent to this property and flows through and across the property, and
WHEREAS, The Council finds that the project as proposed is an appropriate project for the City to participate in under the storm water management ordinance, and further finds that the City should share in 50% of the project cost when finally invoiced in an amount not to exceed $3,712.50, with the condition that the Fair enter into an agreement with the City acknowledging the City’s continuing right to send storm water runoff from the City street system through and across this property in a similar fashion as has been the case in the past and at the present.
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 19th day of March, 2012, does hereby approve The Jones County Fair request for Cost Share under the City of Monticello Code of Ordinances, and agrees to invest an amount equal to 50% of the project costs as proposed, not to exceed $3,712.50, by payment to the Fair upon their presentation to the City of a final invoice and proof of payment.
