RESOLUTION #12-65
Approving Payment related to agreement between City of Monticello and Bob Faust associated with storm water management cost share.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City of Monticello previously enacted a storm water management ordinance to be used by the City for City storm water related purposes, and/or to be used as a cost share with private property owners on storm water related projects, and
WHEREAS, The City previously agreed to share in an eligible private project with Bob Faust and Bob Faust has requested that the City make payment consistent with said agreement, and
WHEREAS, Faust has provided adequate evidence of total storm water retention structure related expenses related to this project, as contemplated by the agreement between Faust and the City, in the amount of $141,148.78, and the City has direct expenses related to this project in the amount of $26,290.24, resulting in a total project cost of $167,439.02, based thereon it appears that the City is obligated under the agreement to pay Faust the sum the not to exceed amount of $76,500, as 50% of the total project cost would exceed $76,500, same totaling $83,719.51, and
WHEREAS, The Council finds that the City has previously paid Faust the sum of $35,387.94, The City Engineer the sum of $8,508.30, and Behrends Crushed Stone the sum of $17,781.94, leaving a balance owing Faust in the amount of $14,821.82 ($76,500 – $61,678.18), and the Council finds it appropriate to pay Faust, under the terms of the agreement, the sum of $14,821.82 in final payment of the City obligation.
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 7th day of May 2012, that it is appropriate for the City to pay $14,821.82 to Bob Faust consistent with the agreement between the City and Bob Faust under, and consistent with, the City of Monticello Storm Water Management Ordinance.
