The City of Monticello, Iowa

IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA

RESOLUTION #13-80

Resolution to approve payment for trees planted adjacent to bike trail near intersection of S. Cedar Street and County Rd E17 (Lower P) in the amount of $100.00 per tree

WHEREAS, Richard Schneiter, tree board members, and other volunteers planted certain trees obtained by/through Richard Schneiter in the R.O.W. near the intersection of S. Cedar Street and South Main Street, and

WHEREAS, the trees were a special Crabapple species with a wholesale value, per Richard Schneiter, in the amount of $175.00 per tree, and

 WHEREAS, a neighboring property owner, Bill Hintz, unilaterally removed two of the four trees, with the claimed belief that they were on his property, and

WHEREAS, Richard Schneiter has submitted an invoice for four trees, including the two destroyed by Hintz, and

WHEREAS, The Council finds it appropriate to pay for two of the four trees from the Tree Board funds with direction to Richard Schneiter to invoice Bill Hintz for the two he destroyed.

NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby authorize and approve of the payment to Richard Schneiter the sum of $200.00 for two of the four trees identified within the invoice submitted by JeMeTy, Inc.

IN TESTIMONY WHEREOF, I have hereunto subscribed my name and caused the Great Seal of the City of Monticello, Iowa to be affixed hereto. Done this 7th day of October, 2013.
