IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA

RESOLUTION #14 – 01

 

Resolution to approve of abandonment and vacation of “Old” 190th Street Right-of-Way, as legally described within the “Plat of Vacated Easement for Public Highway”

attached hereto.

 

WHEREAS, The City of Monticello holds a Right-of-Way interest in what was previously known as 190th Street, same being legally described within the attached “Plat of Vacated Easement for Public Highway being 190th Street, being part of the SE ¼ of Section 33, T.86N. R.3W. and part of the NE ¼ of Section 4, T.85N. R.3W. all of the 5th P.M. in the City of Monticello, Jones County, Iowa, and

 

WHEREAS, Said right-of-way is no longer needed, as with the relocation of State Highway 151, the relevant portion of 190th Street was removed and has returned to farm ground, with 190th Street being relocated to the North and West, a greater distance from the on/off ramps constructed as part of the Hwy. 151 project, and

 

WHEREAS, The City is required to schedule, publish notice, and then hold a Public Hearing when it desires to vacate City ROW, that said Public Notice was made by way of the publication of a notice in the Monticello Express on the 24th day of December, 2013, same scheduling hearing for the 6th day of January, 2014 at 6:00 p.m., and

 

WHEREAS, The Public Hearing was held on January 6th, 2014 at 6:00 p.m. at which time there were no public objections or comments, either oral or written, and

 

WHEREAS, The City Council finds that there is not now, nor will there likely ever be, a continuing need for the existing 190th road right-of-way over the property described herein and that it is wholly appropriate and in the best interest of the City to abandon said right-of-way and return the old right-of-way to the property tax rolls, and

 

WHEREAS, The City Administrator is directed to obtain a Plat of the Vacated Easement for Public Highway and to attach same hereto upon completion.

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Monticello, does hereby officially abandon and vacate all of its right, title, and/or interest in and/or to that portion of 190th Street as described within the Plat of Vacated Easement for Public Highway, same to be completed and attached hereto, and directs the City Administrator to see to the preparation and filing of any and all documents necessary to effect the legal abandonment of said right-of-way.

 

IN TESTIMONY WHEREOF, I have hereunto subscribed my name and caused the Great Seal of the City of Monticello, Iowa to be affixed hereto. Done this 6th day of January, 2014.
