Resolution 19-133

THE CITY OF MONTICELLO, IOWA

IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA

RESOLUTION #19-133

Resolution to approve Building Permit application submitted by Sheldon Hunter related to building located at 115 East First Street, which is located in the Fire Zone

WHEREAS, The Council was previously presented with a Building Permit Application by the owner of property located at 115 E. 1st Street, the building being located in the fire zone, and therefore requiring council review of the Building Permit Application, and

WHEREAS, The Council determined that the inspection of the storefront by a structural engineer on behalf of the City would assist the City in considering the appropriateness and/or necessity of the storefront modifications proposed by the property owner and authorized the City Administrator to proceed with the hiring of a Structural Engineer for that purpose, and

WHEREAS, The City Administrator reports that the Structural Engineer was in town and met with the property owner and the City Administrator to review the current condition of the storefront and to discuss the building owner’s intended improvements, and

WHERAS, The City Administrator further reported that the structural engineer concluded that the proposed modifications, which include the reduction of original window opening sizes, while potentially not necessary from a structural standpoint, would not cause structural problems or concerns, the proposed modifications being more tied to aesthetic or historic considerations, and

WHEREAS, The Council finds that the Permit should be issued with the understanding that the area of the windows framed in cannot be covered with steel or similar products, vinyl, or wood material that is not intended and designed to be a final siding finish, with LP Smartside or similar product being the preferred finish for that area with the requirement that whatever product the owner chooses to use must first be approved by the City Administrator, and if the City Administrator doesn’t find that the proposed product meets the requirements discussed by the Council that the matter will be brought back to the Council for additional consideration.

NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 16th day of September, 2019 that the building permit application submitted by Sheldon Hunter is hereby approved with the understanding that the portions of the current window openings planned to be framed in must be sided with a siding product consistent with the conditions set out within the body of this Resolution.
