IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION # 2022-12
Approving and directing City Administrator to accept ownership of Parcel 2022-11, by the acceptance of a Quit Claim Deed from Senior Housing, Inc and further approving Plat of Survey for Parcels 2022-10 and 2022-11, and directing the City Clerk to see to the recordation of said Deed with the Jones County Recorder
WHEREAS, The City of Monticello has been given a Quit Claim Deed from Senior Housing, Inc., and
WHEREAS, City of Monticello made improvements to Kleinow Field which unintentionally encroached upon the Senior Housing property, .and
WHEREAS, Senior Housing has offered to donate this parcel of land to the City in order to remove a potential liability from their ownership, and
WHEREAS, A Plat of Survey creating Parcels 2021-72 and 2021-73 was previously approved by City Council Resolution #2021-157, and
WHEREAS, The Survey did not get recorded in 2021, it was dated more than 30 days prior to the recording attempt and the surveyor was out town until 2022, all of which has necessitated a change in the Plat of Survey number from 2021 to 2022, and
WHEREAS, The City acknowledges the receipt of the Quit Claim; whereby Senior Housing, Inc. conveys to the City of Monticello, Iowa, the following described real estate in Jones County, Iowa:
Parcel 2022-11 A Parcel of land being part of Lot 10 of the Subdivision of the Northeast part of the W ½ of the SW ¼ of Section 22, Township 86 North Range 3 West of the 5th P.M. in the City of Monticello, Jones County, Iowa and recorded in the Jones County Recorder’s Office
WHEREAS, The Plat of Survey to Parcels 2022-10 and 2022-11 has been presented to the City Council for approval, said parcels being identical to the Parcels previously approved as Parcels 2021-72 and 2021-73, same being located within the City Limits of the City of Monticello, and
WHEREAS, The Plat of Survey was created to parcel off property titled in Senior Housing, Inc., same to be transferred to City of Monticello, and
WHEREAS, The City Council finds that the Plat of Survey to Parcels 2022-10 and 2022-11 should be approved, and
NOW, THEREFORE, BE IT RESOLVED, that the City Council of Monticello, Iowa does hereby approve the Plat of Survey to Parcels 2022-10 and 2022-11 approve of the acceptance of a Quit Claim Deed from Senior Housing, Inc for the property as stated above, and directs the City Clerk to see to the recordation of said deed with the Jones County Recorder.
