IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #11-153
Resolution to request Abatement of accrued taxes related to the Northridge retention structure, a/k/a Northridge Estates 1st Addition Outlot B.
WHEREAS, The City of Monticello acquired the Northridge retention structure, a/k/a Northridge Estates 1st Addition Outlot B, by deed dated 11/12/2010, and
WHEREAS, Taxes for tax year 2010, with a due date of 9/30/2011 in the amount of $152.00 plus $5.00 in interest were not paid when due and the City just received notice of said delinquency, and
WHEREAS, When the City accepted ownership of the Northridge retention structure the City did not receive any pro-rated taxes from the owners / developers, and
WHEREAS, The City acquired the Northridge retention structure to ensure its’ long term maintenance and has as a result thereof taken on the expense of mowing and maintaining the property, and
WHEREAS, The Council finds it appropriate, under the circumstances, to not pay any of the accrued taxes, whether yet due or not, and to so inform the County Treasurer for action to abate said taxes by the County Board of Supervisors as required by the Iowa Code, and
WHEREAS, The City Council finds that the best interests of the City are served by not paying said taxes, as allowed by law, and so informing the Board of Supervisors so that the taxes may formally be abated.
NOW, THEREFORE, BE IT RESOLVED by the City Council that the City Clerk is hereby directed to inform the County Treasurer of the decision of the City Council to not pay any and all taxes accrued prior to the date of the City ownership of the Northridge Estates retention structure (MONCO Parcel Number 0221128012), specifically those set out in a tax delinquency notice in the amount of $157.00 plus any and all continuing costs and interest, if any, and to request that the County Board of Supervisors abate said taxes as required by the Iowa Code.
