IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA

RESOLUTION #2021-157

Approving and directing City Administrator to accept ownership of Parcel 2021-73, by the acceptance of a Quit Claim Deed from Senior Housing, Inc and further approving Plat of Survey for Parcels 2021-72 and 2021-73, and directing the City Clerk to see to the recordation of said Deed with the Jones County Recorder

WHEREAS,  The City of Monticello has been given a Quit Claim Deed from Senior Housing, Inc., and

WHEREAS,  City of Monticello made improvements to Kleinow Field which unintentionally encroached upon the Senior Housing property. Senior Housing has offered to donate this parcel of land to the City in order to remove a potential liability from their ownership, and

WHEREAS,  Senior Housing has offered to donate this parcel of land to the City in order to remove a potential liability from their ownership, and

WHEREAS,   The City acknowledges the receipt of the Quit Claim, that Senior Housing, Inc. conveys to the City of Monticello, Iowa, the following described real estate in Jones County, Iowa:

Parcel 2021-73 A Parcel of land being part of Lot 10 of the Subdivision of the Northeast part of the W ½ of the SW ¼ of Section 22, Township 86 North Range 3 West of the 5th P.M. in the City of Monticello, Jones County, Iowa and recorded in the Jones County Recorder’s Office

WHEREAS,  The Plat of Survey to Parcels 2021-72 and 2021-73 has been presented to the City Council for approval, same being located within the City Limits of the City of Monticello, and

WHEREAS,  The Plat of Survey was created to parcel off property titled in Senior Housing, Inc., same to be transferred to City of Monticello, and

WHEREAS,   The City Council finds that the Plat of Survey to Parcels 2021-72 and 2021-73 should be approved, and

NOW, THEREFORE, BE IT RESOLVED, that the City Council of Monticello, Iowa does hereby approve the Plat of Survey to Parcels 2021-72 and 2021-73 approve of the acceptance of a Quit Claim Deed from Senior Housing, Inc for the property as stated above, and directs the City Clerk to see to the recordation of said deed with the Jones County Recorder.
